The Idaho Supreme Court dismissed a lawsuit filed by Attorney General Raúl Labrador regarding an upcoming ballot initiative on Idaho’s closed primary system. The court ruled that it was too early to determine the constitutionality of the measure and left the door open for Labrador to file another lawsuit in a lower court. The lawsuit sought to challenge a ballot measure put forth by Idahoans for Open Primaries, which aims to end closed primaries and implement ranked choice voting. Labrador accused the organizers of misleading voters, but the court dismissed his arguments on procedural grounds. The decision also did not address the ethical question of Labrador suing a state official while his office represents him in the same lawsuit. The initiative’s organizers denied Labrador’s allegations and celebrated the court’s decision as a win for voters. Labrador now has the option to challenge the signatures in a local court, although time constraints may hinder his ability to do so before the November election. The court also did not address the ethical concerns raised by Labrador’s dual role in the case. Labrador’s office previously defended its actions, stating that they followed all professional rules and protocols.
